Las Vegas Cay Club Litigation Documentation

Update on Las Vegas Cay Club HOA fees

We have been working in the Las Vegas Cay Club condos for several years and there always seems to be surprises with this HOA. Until recently I was under the impression that all of the utilities except the power were covered by the HOA. Well this is not the case. The sewer is not being covered by the HOA. I guess this was a decision that was made some time ago and flew under the radar. We are closing units and now the back sewer bills are showing up and being prorated.

There is another issue that may also be changing soon. There has always been a $500 capital contribution fee in the CC&R's that is due upon transfer of a unit but it has never been collected. In a recent conversation with Eugene Burger Management Co. there is talk of enforcing and collecting this fee in the very near feature. This is going to make short sales harder and harder to close. Even right now I'm having problems getting banks to agree to the excessive back HOA fees and it is starting to look better for them to foreclose as they will then only be required to pay the last six month dues. Crazy!
