Updated Sellers Real Property Disclosure

The Nevada Real Estate Division has published an updated Sellers Real Property Disclosure Form
As of October 1, 2011, the Sellers Real Property Disclosure (SRPD) MAY NO LONGER BE WAIVED!
In accordance with Nevada Law, a seller of residential real property in Nevada must disclose any and all known conditions and aspects of the property which materially affect the value or use of residential property in an adverse manner (see NRS 113.130 and 113.140)
This is not just a law for REALTORS, it impacts ALL sellers in Nevada.

The new form provides the seller a blank to inform the buyer of the type of seller it is, whether it is a bank seller, an asset management company seller, an owner occupier or “other”. ”Other” could include investor.
The new form also provides that:
Systems and appliances addressed on this form by the seller are not part of the contractual agreement as to the inclusion of any system or appliance as part of the binding agreement.
This means that even if a system (like a fountain) or an appliance (like a garbage disposal) is addressed on the SRPD, to be included in the sale it must be addressed contractually.
The new form also addressed methamphetamine under number 6 on page 2 and private transfer fee obligations under number 15 on page 2.
